Article 1 – Purpose

These Terms of Use govern access to and use of the "Trigger Flow" platform available at app.trigger-flow.com. Acceptance of the Terms of Use, Terms of Sale and Service Agreement is mandatory.

Article 2 – Services and Modifications

2.1 Description

The Platform offers marketing automation features: segment creation, email/SMS sending, sales pages, etc.

2.2 Service Modification

The PROVIDER reserves the right to modify or discontinue all or part of the Services at any time, without notice, particularly for technical or commercial reasons.

Article 3 – Account Creation and Use

3.1 Registration

Clients must provide accurate and up-to-date information (company name, email, etc.) and are responsible for the confidentiality of their credentials.

3.2 Compliant Use

The CLIENT agrees to comply with all applicable regulations: anti-spam legislation, GDPR, consumer rights.

3.3 "Beta" Features

Experimental features are provided "as is", without warranty, and may be modified or removed without notice.

Article 4 – Intellectual Property

The Trigger Flow platform remains the exclusive property of the provider. Clients do not acquire any intellectual property rights over the software, trademarks or logos.

Article 5 – Personal Data

5.1 Data Controller

The CLIENT is responsible for data they import or collect through the Platform. The provider acts as a data processor in accordance with the GDPR Annex.

5.2 Security

The provider implements technical measures to secure data, without guaranteeing absolute infallibility.

Article 6 – Limitation of Liability

6.1 Availability

The Platform is accessible "as is" and "subject to availability". No continuous availability is guaranteed.

6.2 Disclaimer of Warranties

The provider disclaims express or implied warranties, particularly regarding merchantability or fitness for a particular purpose.

6.3 Indemnification

The CLIENT indemnifies the PROVIDER against any claims related to non-compliant use of the Platform.

Article 7 – Modification of Terms

The provider may modify these Terms at any time. Major changes will be notified.

Article 8 – Applicable Law and Disputes

These Terms are governed by French law. Any dispute shall be submitted to the competent courts of Toulouse.
