GENERAL CONDITIONS OF SALE

ARTICLE 1 — OBJECT AND OPPOSABILITY

These Terms and Conditions define the conditions for subscribing and paying for subscription packages to the “Trigger Flow” Platform. They apply to all professional CUSTOMERS. Any order implies full acceptance of the CGV.

ARTICLE 2 — OFFERS AND SUBSCRIPTIONS

2.1 Formulas
Discovery : $0/month,
‍Communication : $79/month,
‍Conversion : $179/month,
‍Marketing + : $249/month.

2.2 Sales Page Commission
Transactions generated via the Platform are subject to a commission (between 5% and 15%). The amounts due to the CUSTOMER are paid after deduction of the commission, on a weekly basis.

ARTICLE 3 — ORDERS AND PAYMENT

3.1 Order process
The CUSTOMER subscribes to the subscription chosen online, via bank card. Billing information should be accurate.

3.2 Prices and invoicing
Prices are indicated in euros excluding VAT. Monthly or annual subscriptions are payable in advance. Invoices are sent electronically.

3.3 Refund policy
Except for legal obligations (e.g. right of withdrawal for certain distance sales if eligible), no refund is granted in the event of early interruption. The amounts already paid remain with the SUPPLIER.

ARTICLE 4 — DURATION AND TERMINATION

4.1 Initial duration
The contract is concluded for 12 months, renewable tacitly.

4.2 termination
See Contract for the provision of services (article 7). Any early termination for a serious breach does not entitle you to a refund.

4.3 Consequences
The CUSTOMER may request the export of his data before the actual end. The SUPPLIER deletes the data at the end of the contract (except for legal obligation).

ARTICLE 5 — RESPONSIBILITY

5.1 Obligation of means
The SUPPLIER uses all reasonable means to provide the Platform, without guaranteeing the absence of bugs or the expected marketing effectiveness.

5.2 Limitations
The SUPPLIER cannot be held responsible for indirect damages (loss of turnover, reputation, etc.). The compensation limit is limited to the amounts paid by the CUSTOMER over the last 12 months.

ARTICLE 6 — REVISION OF THE TERMS AND CONDITIONS

The SUPPLIER reserves the right to modify the GTC, provided the CUSTOMER is informed (e-mail, notification). The amended terms and conditions will apply to the following renewals, unless the CUSTOMER refuses and is cancelled before the expiry date.

ARTICLE 7 — APPLICABLE LAW AND DISPUTES

These terms and conditions are governed by French law. Disputes fall under the jurisdiction of the courts of Toulouse.
